Minimum Order Quantity
As a wholesaler, ProfitMarkt may enforce Minimum Order Quantities (MOQ) for specific products or total order values. Orders failing to meet these criteria may be rejected or subject to additional fees.
5. Payment Terms
Payment for Goods is due prior to shipment or as otherwise agreed in writing by ProfitMarkt. We accept various payment methods including bank transfers, credit cards, and other approved payment gateways.

- You represent and warrant that you have the legal right to use the payment method provided.
- We reserve the right to verify payment information before dispatching Goods.
Risk of Loss
All items purchased from ProfitMarkt are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
6. Shipping and Delivery
Delivery times provided are estimates only and are not guaranteed. ProfitMarkt shall not be liable for any delays in delivery caused by events beyond our reasonable control, such as strikes, acts of God, or transportation delays. Shipping costs are non-refundable unless the return is due to our error.
7. Returns and Refunds
Due to the nature of wholesale food products and perishable goods, returns are generally not accepted unless the Goods are defective or damaged upon receipt. In the event of defective Goods, you must notify us within 48 hours of delivery. We will, at our discretion, either replace the Goods or issue a credit note for the value of the defective items. Non-defective returns require prior authorization and may be subject to a restocking fee.

All content included on the ProfitMarkt website, such as text, graphics, logos, images, and software, is the property of ProfitMarkt or its content suppliers and protected by international copyright laws. You may not use, reproduce, modify, or distribute any content from our website for commercial purposes without our express written consent.

To the fullest extent permitted by law, ProfitMarkt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the website. In no event shall ProfitMarkt's total liability to you for all claims exceed the amount paid by you for the specific Goods giving rise to the claim.

You agree to indemnify, defend, and hold harmless ProfitMarkt, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of the website or your violation of these Terms.

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Düsseldorf, Germany.
